Z App – Terms of Use

Welcome to Z App (‘App’) of Z Energy limited (‘Z’, ‘we’ or ‘us’).  By accessing this App you (‘the App Holder’) agree to be bound by the following terms and conditions. If you have any questions, comments, or concerns about the App or these terms and conditions, please contact us at feedback@z.co.nz

  • access any part of the App

You may not:

  • copy, distribute, broadcast, alter or tamper with or otherwise use any material contained in the App except to access any part of the App as set out above
  • remove any copyright, trademark or other intellectual property notices contained in the original material from any material copied or printed off from the App
  • use the App in breach of any legislation or for any unlawful act, or to damage or disrupt the App.

Usage conditions - Z App - General

  • The App Holder will need to have an active internet connection at all times that the App is being used.
  • The App Holder is limited to one App account at any time – multiple accounts or registrations per person are not allowed.

Usage conditions - Z App – Fastlane Trial

    • Fastlane enables Z customers, who have previously registered their Fastlane details on Z App, to fuel their vehicle at designated Fastlane pumps, at selected Z stations taking part in the Fastlane trial, without ever having to go inside the Z store to pay, or pay for their fuel at pump (‘Fastlane’).
    • Some Fastlane customers are able to sign up for Fastlane without Z App. For those customers, these terms and conditions apply to them as if they were an App Holder. 
    • If the App Holder registers for Fastlane, the App Holder agrees to be bound by these “Usage conditions – Z App – Fastlane Trial” terms and conditions. 
    • The App Holder acknowledges that Fastlane is currently operating as a trial (which may be discontinued at Z’s sole discretion) and acknowledges it is only available at a few Z Stations (‘Participating Z Stations’) which can be viewed at: www.z.co.nz/fastlanemap (‘Fastlane Trial’). 
  • The App Holder acknowledges that the Fastlane Trial enables the App Holder to associate a vehicle number plate (‘Number Plate’), which will be read by Z’s cameras, to pay for fuel with their securely stored and pre-provided New Zealand bank credit or debit card, at Participating Z Stations, in accordance with these terms and conditions (’Fastlane Transaction’). 
  • Fastlane provides App Holders the ability to use dedicated Fastlane pumps at Participating Z Stations once they have successfully and correctly inputted each of the following details into the Fastlane functionality in Z App [per Number Plate]:
      • their valid and non-expired credit card or debit card issued by a New Zealand bank or their valid and non-expired Z Business Card  or Z Card (‘Payment Card’) which is eligible for Fastlane (the App Holder can check whether their Payment Card is permitted for Fastlane by attempting to input its details into the Fastlane Registration Process); and 
      • the Number Plate of the vehicle they wish to be registered for Fastlane Transactions; 
      • the correct fuel type for the vehicle they wish to be registered for Fastlane Transactions; and 
  • any other detail as required by Z from time to time.(the ‘Fastlane Registration Process’)Failure to correctly input or complete the details required for the Fastlane Registration Process listed directly above will result in Fastlane being unavailable for use by the App Holder and Z takes no responsibility for this. 
    • The App Holder warrants that they are over the age of 16 year old. 
    • The App Holder acknowledges that not all Payment Cards may be accepted at all  Participating Z Stations when registering for Fastlane. 
    • The App Holder acknowledges they are providing their Credit or Debit Card details to Paymark Limited (‘Paymark’) who securely hold their details on their system. Z will never see nor store the details of the App Holder’s New Zealand bank credit or debit cards - such details are collected, stored and processed by Paymark through their ‘Click’ service, which processes the App Holder’s Fastlane Transactions.  Z does store similar Z Cardand Z Business Card details in their customer database but these details are not stored in Z App. For further information regarding Paymark, and how it encrypts and processes Fastlane Transactions, see the Paymark website (www.paymark.co.nz). 
    • The App Holder will not be able to register or continue to use a Payment Card for Fastlane if it has expired, has been reported stolen by the issuer of the App Holder's Payment Card or is no longer eligible for use in Fastlane for any reason whatsoever. 
  • Z Card holders are no longer able to register their Z Card for Fastlane Transactions as part of the Fastlane Trial. Z Cards that have previously been registered for use with Fastlane are able to use Fastlane. 
  • If the App Holder is using a Z Cardof Z Business Card for Fastlane there will be no ability for an odometer reading to be recorded, and no PIN will be required. Z Cards or Z Business Cards that require a PIN or odometer should not  be used with Fastane. 
  • The App Holder acknowledges that registering their Payment Card in the App provides for a Card Not Present digital occurrence of their physical card. Therefore while the App Holder has a Payment Card registered for Fastlane in the App, if the App Holder’s physical card is cancelled, or expires, the Payment Card registered on the App Holder’s Fastlane account will also be cancelled or expired and Fastlane payment will be not able to be effected.  If the App Holder chooses to cancel or deregister from Fastlane on the App, or delete the App altogether, this will have no effect on their physical Payment Card and their Payment Card will still be able to be used. 
  • Before a Fastlane transaction is authorised by the App, a check is done to make sure that the Z Business Card or Z Card is not over its designated limitHowever it is possible that a Z Business Card or Z Card will be under its designated limit before the Fastlane transaction, but the purchase could cause the limit to be exceeded.  It is the responsibility of the App Holder to ensure that they are operating within the limit of their Z Business Card or Z Card.  
  • If the App Holder’s smartphone or their physical Payment Card is lost or stolen they must immediately cancel all digital occurrences of the App Holder’s Payment Card registered on the App Holder's Fastlane account.  The App Holder can email fastlane@z.co.nz for help deleting or cancelling all digital occurrences of their Payment Card within the App. 
  • The App Holder is limited to one Fastlane account at any time on the App, but may register more than one Number Plate and up to 5 payment methods within one Fastlane account. 
  • The App holder may load more than one Payment Card into the Fastlane Registration Process in the App, which can be associated with different Number Plates. The App Holder may delete or re-add a Payment Card as required. 
  • Upon completion of the Fastlane Registration Process in the App, the App Holder authorises Z to conduct a validation check of the credit or debit card with the relevant bank via Paymark. If the validation check is unsuccessful for any reason, for example, if the App Holder credit or debit card has expired, or their card credit limit, the App Holder will not be able to proceed with their Fastlane Registration Process. 
  • The App Holder authorises a pre-authorisation hold against the App Holder’s credit card account (for credit cards) or bank account (for debit cards) or Z Business  account, for Z Business Cards or Z Cards, equal to the Fastlane Purchase Limit the App Holder has set in the Z App (including GST) (‘Pre-Authorisation Hold’). If a Pre-Authorisation Hold is not granted for any reason, for example, if the App Holder has insufficient funds in either their credit card account or bank account, or their Z Business Card orZ Card has exceeded its velocity or credit limit, the App Holder will not be able to proceed with their Fastlane Transaction. 
  • Z is not responsible for, and has no influence over, the time it takes for the App Holder’s bank (who issued the Payment Card) to release a Temporary Hold or Pre-Authorisation Hold. If the App Holder has any queries on this, Z recommends the App Holder contacts the issues or their Payment Card. 
  • A Pre-Authorisation Hold will be made each time the App Holder authorises payment using a Payment Card for Fastlane. Authorisation is given by the App Holder when a vehicle with the Number Plate is driven into the clearly labelled, orange and indigo Fastlane pump lanes on the forecourt and park up next to the pump that the App Holder intends to take fuel from (‘Selected Pump’). 
  • Multiple Pre-Authorisation Holds may occur from time to time. The App Holder should contact the issuer of their Payment Card (including Z, in the instance of Z Card or Z Business Cards) for any queries regarding these. 
  • Fastlane uses the Number Plates provided during the App Holder’s Fastlane Registration Process via the App. To use Fastlane, the App Holder consents to Z’s forecourt camera(s) reading the Number Plates provided by the App Holder during the Fastlane Registration Process. 
  • The App Holder agrees to use Fastlane by following these steps: 
  1. To correctly register for Fastlane using the Fastlane Registration Process before attempting to fuel up using Fastlane.
  2. When the App Holder using Fastlane is ready to fuel their vehicle, they will drive into the Selected Pump.
  3. The App Holder will wait for the forecourt camera to recognise the Number Plate and for the pump screens to display the words “Welcome to Fastlane”.
  4. Fuel can then be dispensed by the App Holder or the Z Fastlane crew member from the Selected Pump.
  5. The App Holder may cancel the Fastlane request for any reason up until fuel begins to be dispensed by lifting and lowering the Selected Pump handle.
  6. Approval of the Fastlane request is at Z’s discretion. The request will lapse if fuel does not start being dispensed from the Selected Pump within a time out period that starts when the  ‘Welcome to Fastlane' screen is displayed, and ends after a duration determined by Z.
  7. If the App Holder has paid for fuel using Fastlane correctly, Fastlane will confirm this via the pump screen message which will say 'Thanks for visiting' and a confirmation push notification message to the App Holder’s App. 
  8. In the unlikely circumstance where the App Holder has completed fuelling and does not see the “Thanks for visiting” message at the Selected Pump's screen, and/or the App Holder does not see any other message on the Selected Pump screen, any fuel dispensed as part of that Fastlane Transaction into the App Holder’s vehicle will be deemed by Z to have not been charged to the App Holder’s Payment Card and accordingly the App Holder will remain liable for, payment of that fuel. When this happens, the App Holder is required to go in store to pay for the fuel.
  • The App Holder assumes all responsibility for the accuracy of the Number Plates of the vehicles they wish to be registered for Fastlane Transactions when inputting them during the Fastlane Registration Process.  If the App Holder's inputs Number Plates inaccurately, then any person driving the vehicle bearing the Number Plate that has dispensed fuel, will be charged by Z to the Payment Card that the App Holder authorised for Fastlane. 
  • Should the situation arise where the App Holder’s Number Plate is used by another driver, and the App Holder's Payment Card is charged for the fuel, Z will use reasonable endeavours to reconcile the amount attributable to the Fastlane Transaction with the other driver. However, Z may not be able to, and is not required to, reverse charges that the App Holder did not intend to be charged to the App Holder’s Payment Card, as a result of the App Holder entering an incorrect Number Plate when registering to use Fastlane or the App Holder not hanging up the Selected Pump's handle correctly after fuelling is complete. 
  • It is the App Holder's responsibility, when using Fastlane, to ensure that the hose of the Selected Pump has been hung up correctly after fueling is complete. The App Holder will know when the Fastlane pump has been hung up correctly when the 'Thanks for visiting' message is displayed on the Selected Pump screen. If the App Holder does not see this screen, the App Holder will need to re-hang the hose until the “Thanks for visiting” screen appears. If the Fastlane pump has not been hung up correctly, and any person continues pumping fuel from the Selected Pump, any fuel dispensed will be charged by Z to the App Holder’s registered Payment Card. 
  • The App Holder agrees not to fuel or use their smartphone while the vehicle using Fastlane is in motion. 
  • The App Holder acknowledges that during the Fastlane Trial, usual Z promotional activity, such as Pumped discount offers, which would ordinarily provide the App Holder with the ability to redeem a cents per litre discount for a Z fuel purchase, will not be available for Fastlane Transactions.  For the avoidance of doubt, any Z Card or Z Business Card specific discount already in place for the App Holder at account level, will still apply.   
  • Where the App Holder uses Z Business Card as the Payment Card, any restrictions set up by the Account Holder as to the type of fuel that can be purchased, will also apply to Fastlane transaction.  If the App Holder selects a type of fuel in the App that is not authorised by the Account Holder the transaction will be declined. 
  • The App Holder agrees to abide by all Z Safety Rules and Regulations at all times while using Fastlane and the App, including but not limited to, not using their device (such as a smartphone or tablet) in any prohibited areas. 
  • The App Holder agrees that  Fastlane can only be used to fuel a motorbike if the motorbike has a rectangular number plate and is positioned so that it can be read by Z’s cameras at the site. 
  • The App Holder agrees that there is a maximum of three Fastlane Transactions within a 24 hour period. 
  • The App Holder agrees that, if they have registered their Z Card or Z Business Card for Fastlane Transactions, that they will be bound by the Z Card or Z Business Card Terms and Conditions in addition to these Terms and Conditions. During the Fastlane Trial, Z Card and Z Business Card invoices will remain the same in both substance and form and will not specifically display whether a transaction is a Fastlane Transaction or not.
  • From 18 November 2019 a Pumped Daily Discount will be applied to every Fastlane transaction.  For the terms associated with the Pumped Daily Discount and loyalty programme refer to https://z.co.nz/motorists/rewards-and-promotions/pumped/.  When using Fastlane, the App Holder will not be able to stack the Pumped Daily Discount to use later.  If the App Holder already has a stacked discount available on theirPumped balance with Z App at the time of using Fastlane this will automatically be applied to the Fastlane transaction.  Where there are multiple number plates registered, the discount will be applied to the first transaction through Fastlane.  The App Holder will not be able to access any stacked Pumped discounts that relate to Air Points or Fly Buys balances when using Fastlane, but will earn loyalty points on Fastlane transactions where they have included loyalty details in the Z App.  Any loyalty points will be allocated to the loyalty programme selected in the Z App. 

Usage conditions - Z App – Sharetank Trial 

How the SharetankTrial works 

  1. The Sharetank functionality within Z App provides App Holders with the ability to pre-purchase Z91 Unleaded, ZX Premium Unleaded and Z Diesel fuel (‘Fuel’) via Z App (‘Sharetank’).  The Fuel purchased will be depicted in Z App as a virtual Fuel balance in litres, not dollars (‘Sharetank Balance’, which can be used to pay for Fuel dispensed at a Z service station other than Russley (“Z Station”) at a later time.).   

  2. When an App Holder pre-purchases Fuel and adds it to their Sharetank Balance, the App Holder agrees to be bound by these “Usage conditions – Z App – Sharetank Trial” terms and conditions. 

  3. The App Holder acknowledges that Sharetank is a trial service (‘Trial’) offered only by Z Energy Limited (‘Z’). Trial elements may be changed or discontinued at any time. Fuel litres do not expire during the Trial period, but the App Holder must use their Sharetank Balance within a reasonable period of time after purchase.Z will endeavor to give reasonable prior notice of any material changes to the Trial.  If the Trialis discontinued, the App Holder will be given as much notice as possible (and not less than 90 days) via the email used to register for Z App and (if enabled) a Z App notification.  This notice will alert the App Holder to the time frame available to draw down any remaining Sharetank Balances.  Any Sharetank Balances not completely drawn down at the expiry of the notice period may be forfeited.  

  4. A Sharetank Balance (or part thereof) can be drawn down to pay for an App Holder’s Fuel purchase at all Z Stations across New Zealand  where the Z App Holder has coverage and is able to use the Z App, provided that the relevant grade of Fuel is available at that Z Station.  To do this, the Z App Holder must scan their unique Sharetank ‘My Z’ QR code that displays in the Z App in the App Holder’s smartphone (“Sharetank My Z”) at the in-store register or at the outdoor payment terminal (“OPT”at the pump where available. 

  5. A Sharetank Balance may also be drawn down to pay for an App Holder’s Fuel transaction at any Fastlane found at a Z Station, if the App Holder has set this up as an option using the settings under the App Holder’s Fastlane account. Only Sharetank Administrators (not Sharetank Members) can use Sharetank at Fastlane, but the Administrator is able to add multiple number plates to their Fastlane account with Sharetank selected as the payment option.  The App Holder may also enable settings in the Fastlane section of Z App so that a Sharetank Balance is only used when the weighted average cost of the Sharetank Balance is lower than the pump price.   

  6. A Sharetank Fuel Balance is held in litres not dollars.  There is no dollar value associated with the Sharetank Balance. Sharetank Balances cannot be sold, refunded or exchanged for cash. An App Holder’s Sharetank Balance is not a representation of the Fuel balance in their vehicle.   

  7. The App Holder can add to their Sharetank Balance by pre-purchasing Fuel. No more than 1,000 Litres of Fuel may be purchased in any single transaction and the balance of each Fuel grade cannot exceed 1,200 litres at any one time.  An App Holder’s Sharetank purchases cannot exceed 12,000 litres per Fuel grade over a 12-month period.  Z may suspend an App Holder’s use of Sharetank, put a hold on it or reverse a transaction if Z has reason to believe that there may be misuse or dishonesty on the part of the App Holder or a third party.   

  8. An IRD approved GST receipt will be issued by email to the App Holder after each Sharetank Fuel purchase within the App. Receipts issued at the time of redemption at a Z Station will not include GST amounts for tax purposes. 

  9. If Z App is down, unavailable, or there are connectivity issues, the App Holder must always have another means to pay for their Fuel purchase.  

“Lowest Z pump price in your area 

10. Sharetank’s “lowest Z pump price in your area” guarantee offers you the lowest Z pump price within a 30km radius, for each grade of Fuel. Where there are no Z Stations offering that Fuel grade within a 30km radius, Sharetank will offer you the nearest Z pump price across all grades. To get the lowest pump price in your area: 

a. Sharetank’s “Lowest Z pump price in your area” guarantee uses location services on a customer’s mobile device. 

b.App Holders will be prompted to allow Z App to use their location when they install the Z App or when they access Sharetank within the Z App. 

c. If the App Holder does not enable location services, they will be unable to purchase any Fuel through Sharetank 

d. To enable location services on iOS, go to Settings > Privacy > Location Services and turn Location Services “On” if it is off. Then scroll down to find the Z Energy App and select “While Using the App.” 

e. To enable location permissions on Android, go to Settings > Location > and turn Location “On” if it is off. Then select App-level permissions and scroll down to Z and slide the switch on. 

f. Z will use the App Holder’s smartphone’s location as determined by the device’s operating system.  The App Holder must not interfere with the device settings in a manner that could provide incorrect location information.  If Z detects that such interference has occurred, it may suspend the Sharetank account and/or reverse a particular Fuel purchase. 

11. Sharetank’s “lowest Z pump price in your area” guarantee excludes all Z truck stops and does not reflect other Z discounts and/or price promotions (such as Pumped programme discounts, and supermarket fuel discount dockets).   

Loyalty points and exclusions 

12. Sharetank litres cannot be redeemed in conjunction with any other Fuel discounts or offers (such as Pumped discounts, and supermarket discount dockets).

13. If the Sharetank Balance is used to pay in-store and the amount of Fuel pumped is larger than the Sharetank Balance, then the App Holder will be required to use another payment method to complete the transaction.

14. If the Sharetank Balance is used to pay at the OPT on the pump, then the App Holder will only be authorized to pump the actual amount of their Sharetank Balance or 100 litres whichever is larger. 

15. Sharetank cannot be used for any Fuel transaction at Z truck-stops or in conjunction with fuel cards (such as Z Business Card). 

16. The App Holder can earn AirPoints or Fly Buys loyalty points on their Sharetank purchases.  To add a loyalty account, select “My Z” in Z App and then select “Add AirPoints” or “Add Fly Buys” and add the relevant card number. Customers can register both Fly Buys and AirPointscard numbers in the App but they can only have one “active” at a time. If a Fly Buys or Airpoints account is registered against a Shared Sharetank, only the Sharetank Administrator will be able to earn Airpoints Dollars or Fly Buys loyalty points 

17. Airpoints Dollars or Fly Buys loyalty points are earned on the purchase of Fuel in Sharetank and not when redeeming those litres at a Z Station. 

18. Promotional bonus offers are at the sole discretion of Z and may be varied including the thresholds they are offered at. 

Proactive Price Guarantee 

19. Sharetank offers a ‘proactive price guarantee’ whereby the App Holder will be informed by the customer service representative in the Z Station or electronically via Z App when paying at the OPT that the current pump price at that Z Station is lower than the merged Sharetank purchase price (‘Merged Price’). The Merged Price is calculated as the weighted average purchase price of Sharetank litres, per Fuel grade. The App Holder may then choose to pay by another means or draw down on their available Sharetank Balance.  

20. In the instance where the App Holder redeems a Sharetank Balance using Fastlane, the settings that apply within their Fastlane account will apply and determine whether the Sharetank Balance is used or the authorised payment card stored in the Z App.   

21. If the Customer is eligible for a discount on the pump price then the Customer will need to determine whether they should use their Sharetank Balance or pay by another means at the discounted pump price available to them. 

Sharing your Fuel Balance with Others 

22. The App Holder can invite up to five (5) people to share their Sharetank Balance by sending a unique code associated with the App Holder to the invitee. The invitee enters the code into their Z App (an ‘Invitation’) to request access to the App Holder’s Sharetank Balance.  When one or more invitees is confirmed by the App Holder, the Sharetank Balance becomes shared (‘Shared Sharetank). The App Holder cannot charge any sort of fee or price to an invitee.  For the purposes of these terms, when the App Holder sends an invitation and an invitee is confirmed, they become an administrator of (what was) their own personal Sharetank (‘Sharetank Administrator’). 

23. The Sharetank Administrator can send more than five (5) Sharetank invitations, but only the first five (5) that are confirmed by the Sharetank Administrator will be granted access to the Sharetank (a ‘Sharetank Member’). If the Sharetank Administrator then wants to add another member, they must remove one of the existing Sharetank Members first.  

24. The Sharetank Administrator can make up to 8 changes to the Sharetank membership within a 12-month period. 

25. Any balance held by a Sharetank Member as they join a new Sharetank, will not be transferred into the Sharetank Administrator’s Sharetank, and will remain available to them if, and when, they leave the other person’s Sharetank. 

26. Each Sharetank Member can access the full Sharetank Balance across all Fuel grades without restriction. Any App Holder that invites others into their Sharetank accepts that they are providing full access to those members to draw down on any available balance at any time. 

27. An App Holder cannot have both their own personal Sharetank and participate in a Shared Sharetank.  An App Holder can only participate in one (1) Sharetank at any time. 

28. App Holders who join a Shared Sharetank acknowledge that the Sharetank Administrator can remove their access at any time and if access is removed they will no longer be able to view or use the Shared Sharetank.  If a Sharetank Member is removed from a Shared Tank, they will be notified through an in-app notification. 

29. Only the Sharetank Administrator can purchase Fuel to ‘top-up’ the Sharetank Balance. 

30. If an App Holder no longer wants to participate in Sharetank, they may simply halt using the Sharetank service, or, draw down their Sharetank Balance to zero and remove all Shared Sharetank Members.  

31. App Holders who participate in a Shared Sharetank and redeem Fuel using the Z App agree and acknowledge that their Sharetank transaction details will be accessible in the ‘Sharetank activity’ and ‘Sharetank top-ups’ section of Z App by other Members of the Shared Sharetank. Transaction details may include: Name, Redemption Location, Fuel Litres, Savings versus pump price and Total Transaction Value. If the transaction is completed at a Z Fastlane, the transaction details will include the vehicle Number Plate. Transaction details may change from time to time at Z’s discretion.  

 

Usage conditions - Z App – Z Espress Coffee Card

  • The App’s Z Espress Coffee Card is able to be used at participating Z Stations, where Z Espress coffee is available – participating Z Stations are listed on z.co.nz/coffee.
  • The App Holder will receive one electronic stamp per full priced hot drink purchased by the App Holder from any participating Z Station in a single transaction. Stamps can only be awarded at the time of purchase, and will not be applied retrospectively. Each stamp counts towards the quota of electronic stamps needed to earn a free hot drink voucher.
  • After six electronic stamps have been collected the App Holder will receive electronic notification of one free hot drink voucher (the ‘Z Espress Voucher’). Z Espress Vouchers can be redeemed for any hot drink at participating Z Stations. The free hot drink can be small, medium or large and can include decaf, soy milk and shots.
  • For App Holders purchasing less than six hot drinks in a single transaction, when six electronic stamps have been collected, a Z Espress Voucher will be stored on their Z App for their next hot drink purchase at a participating Z station.
  • For App Holders purchasing six or more hot drinks in a single transaction, every 6th hot drink in that transaction will generate one free hot drink voucher. The App Holder will continue to receive electronic stamps following their 6th hot drink. For example:
    • If the App Holder has no current electronic stamps and purchases 6 hot drinks in a single transaction, they will receive one free hot drink voucher, and receive no electronic stamps on their Z App;
    • If the App Holder has no current electronic stamps and purchases 10 hot drinks in a single transaction, they will receive one free hot drink voucher, and receive 4 electronic stamps on their Z App;
  • Z Espress Vouchers are valid for 90 days from date of issue (the ‘Expiry Date’) and are not exchangeable for cash.

 

Usage conditions - Z App – Z2O Car Wash Card

  • The App’s Z2O Car Wash Card is able to be used at participating Z Stations, where Z2O Car Washes are available – participating Z Stations are listed on z.co.nz/carwash.
  • The App Holder will receive one electronic stamp per full priced Z2O Max Wash or Z2O Max Wash & Vac purchased by the App Holder from any participating Z Station in a single transaction. Stamps can only be awarded at the time of purchase, and will not be applied retrospectively. Each stamp counts towards the quota of electronic stamps needed to earn a free Z2O Max Wash voucher.
  • After 4 electronic stamps have been collected the App Holder will receive electronic notification of one free Z2O Max Wash voucher (the ‘Z2O Voucher’). Z2O Vouchers can be redeemed for a Z2O Max Wash at participating Z Stations.
  • Z2O Vouchers are valid for 90 days from date of issue (the ‘Expiry Date’) and are not exchangeable for cash.

Usage conditions - Z App – SWAP’n’GO Card

  • The App’s SWAP’n’GO Card is able to be used at participating Z Stations, where SWAP’n’GO bottles are available – participating Z Stations are listed on z.co.nz/find-us.
  • The App Holder will receive one electronic stamp per full priced SWAP’n’GO bottle purchased by the App Holder from any participating Z Station in a single transaction. Stamps can only be awarded at the time of purchase, and will not be applied retrospectively. Each stamp counts towards the quota of electronic stamps needed to earn a $4 off SWAP’n’GO bottle discount voucher.
  • After 3 electronic stamps have been collected the App Holder will receive electronic notification of a $4 off SWAP’n’GO bottle discount voucher (the ‘SWAP’n’GO bottle Voucher’). SWAP’n’GO bottle Vouchers can be redeemed for a voucher for $4 off the full priced SWAP’n’GO bottle at participating Z Stations.
  • SWAP’n’GO bottle Vouchers are valid for 90 days from date of issue (the ‘Expiry Date’) and are not exchangeable for cash. 

Usage conditions - Z App – Pre-Order Coffee 

  • The Pre-Order Coffee feature of Z App enables Z customers, who have previously downloaded and registered their details in Z App onto their smartphone, to order Z Espress coffee or hot drinks  via Z App to be picked up at a pre-determined time at selected Z stations participating in the Z Pre-Order Coffee (‘Z Pre-Order Coffee’) 

  • If the App Holder uses the Pre-Order Coffee feature, the App Holder agrees to be bound by these Usage conditions – Z App – Pre-Order Coffee terms and conditions. 

  • If the App Holder suffers from any food allergies, please let Z Espress’ barista know by clearly communicating what you are allergic to in the “notes” field during the Z Pre-Order Coffee ordering process. Z baristas will use their best efforts to meet your requirements, however Z and its affiliates (including Z retailers) will assume no liability for any allergic reactions that occur from incorrect order processing or cross contamination or other such error. 

  • The Pre-Order Coffee feature provides App Holders the ability to pre-order their preferred coffee or hot drink at Participating Z Pre-Order Stations once they have successfully and correctly inputted each of the following details into Z App: 

  • their valid and non-expired credit card or debit card issued by a New Zealand bank (‘Credit or Debit Card’) which is eligible at Z (the App Holder can check whether their Credit or Debit Card is permitted for Z Pre-Order Coffee payment by attempting to input its details into the Pre-Order Coffee Process); and 

  • any other detail as required by Z from time to time  

(the ‘Pre-Order Coffee Registration Process’) 

Failure to correctly input or complete the details required for the Pre-Order Coffee Registration Process listed directly above will result in Pre-Order Coffee functionality being unavailable for use by the App Holder and Z takes no responsibility for this. 

  • If the App Holder has successfully ordered and paid for a coffee or hot drink using the Z Pre-Order Coffee feature, but cannot pick up their coffee or hot drink until after the time they selected, Z will make the App Holder a fresh coffee or hot drink on the App Holder’s arrival at the Participating Z Pre-Order Station the App Holder chose to pick their coffee or hot drink up from. Z will also make the App Holder a fresh coffee or hot drink if the coffee or hot drink the App Holder successfully ordered and paid for using the Z Pre-Order Coffee feature, was not hot enough when the App Holder picked the coffee or hot drink up at the App Holder pre-selected pick up. 

  • Once the App Holder has successfully ordered and paid for a coffee or hot drink using the Z Pre-Order Coffee feature, the coffee or hot drink order cannot be cancelled and the App Holder will not be entitled to a refund for this reason. Similarly, if the App Holder finds themselves unable to collect their coffee or hot drink after they have ordered and paid for it through the Z Pre-Order Coffee feature, they will not be entitled to a refund for this reason, 

  • The App Holder acknowledges that not all Credit and Debit Card may be accepted at all Participating Z Pre-Order Stations when registering for Z’s Pre-Order Coffee. 

  • The App Holder acknowledges they are providing their Credit or Debit Card details to Paymark Limited (‘Paymark’) who securely hold their details on their system. Z will never see nor store the details of the App Holder’s Credit or Debit Cards. Such details are collected, stored and processed by Paymark through their ‘Click’ service, which processes the App Holder’s Pre-Order Coffee transaction.  For further information regarding Paymark, and how it encrypts and processes Pre-Order Coffee transactions, see the Paymark website (www.paymark.co.nz). 

  • Upon completion of the Z Pre-Order Registration Process in the App, the App Holder authorises a temporary hold against the App Holder’s Payment Card of NZ$1 (including GST) (‘Temporary Hold’). If a Temporary Hold is not granted for any reason, for example, if the App Holder has insufficient funds in either their credit card account or bank account, or their Z Card has exceeded its velocity or credit limit, the App Holder will not be able to proceed with their Z Pre-Order Registration Process.

  • The App Holder will not be able to register or continue to use a Credit or Debit Card for Pre-Order Coffee if it has expired, has been reported stolen by the issuer of the App Holder's Credit or Debit Card or is no longer eligible for use in Pre-Order Coffee for any reason whatsoever. 

  • Z Card holders will not be able to use or register their Z Card for payment of Z Pre-Order Coffee during the duration of the Pre-Order Coffee Trial. 

  • The App Holder acknowledges that registering their Credit or Debit Card in App provides a for a Card Not Present digital occurrence of their physical card. Therefore while the App Holder has a Credit or Debit Card registered for Pre-Order Coffee in Z App, if the App Holder’s physical card is cancelled, or expires, the Credit or Debit Card registered on the App Holder’s Pre Order Coffee account will also be cancelled or expired and Pre Order Coffee payment will be not able to be effected.  If the App Holder chooses to cancel or deregister from the Z Pre-Order Coffee on the App, or delete the App altogether, this will have no effect on their physical Credit or Debit Card and their Credit or Debit will still be able to be used. 

  • If the App Holder’s smartphone or their physical Credit or Debit Card is lost or stolen they must immediately cancel all digital occurrences of the App Holder’s Credit or Debit Card registered on the App Holder’s Z Pre-Order Coffee account.  The App Holder can email preorder@z.co.nz  for help deleting or cancelling all digital occurrences of their Credit and Debit Card with App. 

  • The App Holder may delete or re-add a Credit or Debit Card by removing their current Pre-Order Coffee registration and completing the Pre-Order Coffee Registration Process again.  

  • The App Holder acknowledges that Air New Zealand Airpoints loyalty points will not be able to be earned on Z Pre-Order Coffee purchases. You will receive one Fly Buys point per one Z Espress drink order when scanning your Fly Buys card. 

  • Coffees or hot drinks purchased successfully by the App Holder, using the Z Pre-Order Coffee feature on Z App, will be eligible for the Z Espress Coffee Card.  The terms of the Z Espress apply, see the “Usage conditions - Z App – Z Espress Coffee Card” below. 

  • The App Holder agrees to abide by all Z Safety Rules and Regulations at all times while using Pre-Order Coffee and the App, including but not limited to, not using their device (such as a smartphone or tablet) on the forecourt and other prohibited areas.  

Costs

You are responsible for all costs incurred in downloading and using the App.

Application of these terms

Additional terms may apply to specific goods or services (‘Products’) or online tools provided through the App. If the App links to any additional terms as well as these terms for a particular product or tool, you must read these terms and the additional terms together. If there is any inconsistency between these terms and the product or tool-specific terms, the product or tool-specific terms will prevail.

Intellectual property rights

The App contains material including text, photographs and other images and sound, which is protected by copyright and/or other intellectual property rights. All copyright and other intellectual property rights in this material are either owned by Z or our subsidiaries, or have been licensed to us by the owner(s) of those rights so that we can use this material as part of the App.

The App also contains trademarks. All trademarks on the App belong to Z or have been licensed to it by the owner(s) of those trademarks for use on the App.

External links

The App may include links to external websites. Z is not responsible for the owners or operators of these websites or for any goods or services they supply. Nor is it responsible for the content of their websites and does not give or enter into any conditions, warranties, or other terms or representations in relation to any of these, or accept any liability in relation to any of these. This includes any liability arising out of any claim that the content of any external website to which the App includes a link infringes the intellectual property rights of any third party.

Data protection

To use the App, the App Holder must register with Z by providing personal information.  All personal information provided to Z through the App will only be used in accordance with our privacy policy. 

The data and information that the App Holder provides Z, including but not limited to any personal information the App Holder submits for the purpose of registering with or otherwise using the App, may be used by Z or its authorised third party contractors to: 

  • Provide the App Holder with the App (including by disclosing personal information to an authorised third party contractors). 

  • Contact the App Holder with information regarding the App. 

  • Monitor the App Holder’s use of the App. 

  • Report on App usage to help us improve the App. 

  • To identify offers available to the App Holder, tell them about these offers and provide such offers whether through the Z App or other channels (including email).

No data transmitted via the App can be guaranteed to be secure. Any information submitted using the App is done so at the App Holder’s own risk. Z may periodically send promotional emails or promotional messages via the App called Push Notifications about new products, improvements, special offers or other information which we think you may find interesting. You may opt out of receiving these at any time through the notification options on your phone or through the unsubscribe link in any email. Changes to terms and conditions

Z may change the terms, conditions and disclaimer set out above from time to time. By using the App you accept that you are bound by the current terms, conditions and disclaimer, and you should check these each time you revisit the App.

Changes to/operation of the App

Z may change the format and content of the App at any time. Z may suspend the operation of the App for support or maintenance work, in order to update the content, or for any other reason.

Z reserves the right to terminate access to the App at any time and without notice.

Our liability

All information or advice included on the App is intended to be general in nature and you should not rely on it in connection with any decision you make. Z tries to ensure that all information provided in the App is correct but does not guarantee its accuracy. Z is not liable for any action you may take as a result of relying on such information or advice, or for any loss or damage suffered by you or any third party as a result of you or a third party taking this action.

We will not be liable for any loss or damage (direct or otherwise) you or any third party suffer in connection with the use of the App or the use of, or reliance on, content contained in or accessed through the App . We also exclude any condition or warranty that could be implied into these terms (but only to the extent that this is allowed by law).

Force majeure

Z shall have no liability to the App Holder if it is prevented from, or delayed in performing, the App by acts, events, omissions or accidents beyond its reasonable control, including (without limitation) industrial disputes (whether involving the workforce of Z or any other party), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors.

No warranty

Z makes no representations and gives no warranties that the App will be capable of running on the App Holder's iPhone, iPad, Android device computer equipment and software.

Z gives no warranty that the App will be free from technical glitches, computer viruses, worms, software bombs, Trojan horses or similar items.

Z will not be liable (whether in contract, tort including negligence, equity or any other basis) for loss or damage to data, or viruses or similar items that may infect the App Holder's iPhone, iPad, Android device computer equipment and software due to the App Holder's use of the App.
